The Supreme Court is set to pronounce a historic judgment on triple talaq today. It would either declare the practise as valid or unconstitutional or let the government take a decision on the matter.
In a major victory for women’s rights, the Supreme Court of India struck down triple talaq while declaring it unconstitutional. In a 3:2 majority verdict the court held that the practise was unconstitutional and it violates fundamental rights of a woman as it irrevocably ends marriage without any scope of reconciliation.
The Supreme Court today by a 3:2 majority struck down triple talaq. While the CJI and Justice Nazeer were in favour of the practise the other three judges observed that the practise was unconstitutional.
