The Supreme Court on Thursday restored the marriage of Hadiya with her husband Shafin Jahan. While upholding the marriage, the court however told the NIA that it could continue its probe into the Love Jihad case.
The Hadiya case was up before the Supreme Court a couple of days back. The court said that Hadiya should be permitted to study and it would hear the matter pertaining to her marriage with a Muslim man at a later date.
The Supreme Court said that a wife is not a chattel and husband cannot be her guardian. The observation was made during the hearing in the Hadiya case on Monday.
The National Investigation Agency has said that Hadiya had married a Muslim man of her own will. The NIA in its status report said that it also did not find any financial trail linking Hadiya or others in the case.
An application has been filed in the Supreme Court urging that the interaction in the Kerala Love Jihad case be held in-camera. The father of the girl who converted to Islam before marrying a Muslim man has sought that the proceedings be held in-camera and not in open court.
Forced conversions in Kerala are a reality and is getting very serious. The National Commission for Women in-charge Rekha Sharma who met with Hadiya, the woman whose marriage with a Muslim man was annulled said that many types of lures, many other threatenings, blackmailing, all types of things are happening. This is not one small thing which we are reading in Delhi… But this is getting serious.
In a report submitted to the Kerala Women’s Commission, the police have said that Akhila alias Hadiya is not being tortured by her father. The commission had sought a report after a video of the lady surfaced in which she is alleged to have accused her parents of torture.
I have no objection to my daughter marrying into any religion, but this group has a terrorist connection Akhila alias Hadiya’s father has alleged. The Supreme Court had directed that she be presented before the court next month and her father Ashokan had welcomed the decision.
The Kerala State Women’s Commission has directed the police to inquite and submit a report on the current condition of Hadiya. The commission directed the Kottayam superintendent of police to find out about the condition of Hadiya, probe the matter and submit a report.
